Regulation ensures the broker follows strict financial standards, segregates client funds, and provides dispute resolution. In Ukraine, unregulated brokers have caused significant losses. Always check for a valid license from a reputable authority.
Step 1: Identify the Broker's Regulator
Visit the broker's website and scroll to the footer. Look for a license number and the regulator's name (e.g., 'CySEC license number 123/45' or 'FCA reference number 789012'). For Ukrainian traders, a broker may claim NSSMC regulation, but this is rare. Most regulated brokers are from Cyprus (CySEC), UK (FCA), or offshore (FSA).
Step 2: Visit the Regulator's Official Website
Go directly to the regulator's official site (e.g., cysec.gov.cy for CySEC, fca.org.uk for FCA, or nssmc.gov.ua for NSSMC). Do not use links from the broker's website—they could be fake. Navigate to the 'Register' or 'Check a Firm' section.
Step 3: Search for the License Number
Enter the broker's license number or name in the regulator's search tool. Confirm the exact name matches the broker's trading name. For example, if the broker is 'XYZ Global Ltd', check that the regulator lists this exact entity. Also verify the license status is 'Active' or 'Authorised'.
Step 4: Cross-Check the Website and Regulatory Details
Compare the broker's address, contact details, and regulatory claims with the regulator's records. If the broker claims to be regulated by the FCA but the FCA register shows a different address or no matching record, it's a red flag. For CySEC, ensure the broker is listed under 'Investment Firms'.
Step 5: Check for Client Fund Protection
Regulated brokers must offer negative balance protection and segregate client funds. For CySEC brokers, client funds are held in separate bank accounts. For FCA brokers, the Financial Services Compensation Scheme (FSCS) covers up to £85,000. Ukrainian traders should prioritize brokers with these protections.
Step 6: Verify with Local Resources
Use Ukrainian forex forums and communities (e.g., Minfin.com.ua, Forex.ua) to check trader reviews about the broker's regulation. Also, contact the NSSMC directly if you suspect a broker is falsely claiming local regulation. They have a public database of licensed financial firms.
